Terms and Conditions

PLEASE READ THIS AGREEMENT CAREFULLY AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS, INCLUDING VARIOUS LIMITATIONS AND EXCLUSIONS, AND A DISPUTE RESOLUTION CLAUSE THAT GOVERNS HOW DISPUTES WILL BE RESOLVED.
This program is subject to change by Christie Spaces at any time, effective upon posting on the relevant website. Your continued use of the program following Christie Spaces posting of revised terms of any section of the Agreement will constitute your express and binding acceptance of and consent to the revised Agreement.

Welcome to Christie Spaces Referral program, operated by Christie CoWork Pty Ltd. By using this program, the related mobile website, and the mobile application (collectively, the “Websites”), you agree to be bound by these Terms of Service (this “Terms of Service” or “Agreement”), whether or not you register as a member of Christie CoWork ("Member"). If you wish to become a Member and/or make use of the service (the “Service”), please read this Agreement. If you object to anything in this Agreement or the Christie Spaces / Christie CoWork Privacy Policy, do not use the Service.

1. Access and Retention

In order to access and retain this electronic Agreement, you must have access to the Internet, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, you must use all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. Please print a copy of this document for your records. To retain an electronic copy of this Agreement, you may save it into any word processing program.

2. Referee

A referee needs to apply for the referral program and accept these terms and conditions. Application is made by way of a profile. Each referral (individual / company) must be completed a single submission. Acceptance will be made once all information has been collected and verified by the Community Manager. Part of the verification will be to have the consent of the referred entity.

3. Referral

A referral must not be a current member or previous member of Christie Spaces. The referral must not have previously enquired with Christie Spaces. The referral must become a member no later than 1 month after taking a site tour visit to a location. The referral must not be a subsidiary entity of the parent company or have any company group association or have a related employment interest. Referrals are rewarded on a timely basis subject to an existed agreement between agents (non-members).

4. Programs & Payments (Gifts)

There are 3 referral programs which define the payment (Gift).

Individual Member Referrals: Once you been accepted onto the Christie Spaces app platform you are a member of the community and via the app you can automatically start referring and tracking your referrals. A Christie Cash Gift Card will be gifted to the member for 10% of the first month’s rent of the referral. The gift will occur the month following once the first payment made by the referral has been reconciled.

Partners Referrals: Application to the Partner Referral Reward Program is made via the website. Once approved, the partner can start referring new members. Christie Spaces will pay a 10% commission based on the original membership agreement (not including additional services) for the first 12 months’ rent. This payment will also be calculated pro rata if the referral was to move out. If your company is a member the payment can be credited against your membership invoice or a Recipient Created Tax Invoice can be nominated. The payment will occur the month following once the first payment made by the referral has been reconciled.

Agent Referrals: Application to the Agent programs is made via the website.

Christie Spaces will pay a commission based on the original membership agreement (not including additional services) based on the first 12 months. The payment will occur the month following once the first payment made by the referral has been reconciled.

5. Changes in the referral membership

Christie CoWork will pay the lesser referral commission of the initial referral membership and any changes in membership in the 12 month period. The start date will be referred to as the time and date the initial membership was made effective despite any changes and relocations to other locations. The fee will be calculated to reflect any discounts and adjusted over the 12 months accordingly.

6. Privacy

Use of the Websites and/or the Service is also governed by our Privacy Policy, located at www.christiespaces.com.au

7. Jurisdiction and Choice of Law; Dispute Resolution

Christie reserves the right to make determinations under these rules, without limitations, to the eligibility of the referee and the referral amounts payable. Christie CoWork reserves the right to disqualify any referee if deemed to have breach the terms and conditions. You agree you will not act or represent Christie Spaces (Christie CoWork) nor entitled to make any commitment on behalf of Christie CoWork. If there is any dispute arising out of the program, you expressly agree that any such dispute shall be governed by the laws of Australia without regard to its conflict of law provisions, and you expressly agree and consent to the exclusive jurisdiction and venue of the state and federal courts of Australia, for the resolution of any such dispute. Acceptance of the terms and conditions of this Agreement constitutes your consent to be sued in such courts and to accept service of process outside Australia with the same force and effect as if such service had been made within Australia. You hereby agree to accept service of process for any action hereunder by certified mail return receipt requested which service shall have the same force and effect as though service had been effected by personal service in the applicable jurisdiction. If any part of these terms is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
